Every year the legislature gets to work on all area's of law and DUI laws are no exception. This past session was no exception and although it was not as active in DUI legislation as past sessions, there were numerous amendments to old laws and a few new laws passed ones as well. At the time of this show, the laws discussed were approved by the legislature and had been delivered to the Governor, but not yet signed into law. Although it is expected that all passed legislation will be signed and enacted, make sure you double check.

All the changes discussed will take effect August 1, 2012 and the Legal Docket will revisit them Post August 1 to review and confirm. In the meantime, if you need to discuss your case, arrest, or have a pending or an un-filed action, and need a DUI trial lawyer, make sure they have a focus on DUI.

A favorite movie of mine is "Grosse Point Blank." I am reminded of a scene from it when i think of 10 years of practice as a DUI Attorney. It is a scene where John Cusack runs into an old high school friend after he visits his old high school flame who is now a radio host. John Cusack and his friend simply look at each other and then his friend yells "10 years! 10 years man! Where have you been for 10 years?"

10 years is a benchmark in our lives for many things like a high school reunion, marriage, our kids hitting double age digits, etc. The importance of 10 years permeates our North American culture and when you listen to this show, you will see just how important 10 years is in the DUI landscape. Recently the United States Supreme Court found a search of a defendant's vehicle when a GPS device was attached a day beyond the permission granted by the warrant and when the vehicle was in a different State. At the time of this show the news was reporting that a new DUI legislative bill was afoot and becoming popular. The Bill included other new DUI laws, but the notion of awarding child and/or alimony support for the family of victim killed by way of a DUI was the main subject of discussion. The Bill is being sponsored, or supported by Senator Goodman who has traditionally been the promoter and spokesperson and advocate for many of the most recent changes. While I neither advocate for, nor against this Bill at this time, nor on this show i do hope to inspire some rational and logical thinking of this Bill's long term ramifications. A "good idea" may be just that, an idea, as the practical applications are fraught with undesired and unintended consequences.

The recent case of a Seattle man who requested the video tape of his arrest as he believed it exonerated him, but was told it did not exist. After pursuing the issue the defendant learned that it not only existed, but others of his arrest also were in existence and the tapes did exonerate him. In so doing, they once again exposed the ugly side of law enforcement personalities as various negative and derogatory comments by the officers were also recorded.

A Commercial Drivers License (CDL) is a career for most CDL holders. A DUI arrest for a CDL holder in a personal vehicle can have career ending consequences. A Personal Drivers License can be lost for 90 days, 1 year, 2 or more, but a CDL is lost for 1 year, or for life depending on the CDL holder's record unrelated to prior DUI arrests. If you hold a CDL and you are arrested for a DUI off -duty you face the potential loss of your career. If you are arrested for a Commercial Motor Vehicle DUI because you are over the .04 limit you again face a loss of the CDL for1 year at a minimum. Even if you are less than a .04 breath you face not only the loss of your CDL, but a criminal conviction for driving a Commercial Motor vehicle with alcohol in your system.
